오늘은 교통사고가 났을 때의 대처법 세번째, 내가 운전자나 보행자가 아닌, 승객이었을 경우 대처법을 알아보겠습니다.

3. 자동차의 승객, 대중교통의 승객이었으나 다른 차와의 충돌로 다쳤을 경우

다만, 이 경우 No-fault는 운전자가 가진 보험을 상대로, 그리고 Bodiliy Injury Claim은 운전자 및 다른 상대방을 상대로 모두 클레임을 오픈할 수 있다.
하지만 다른 상대방 차를 찾아내지 못하면 운전자만을 상대로 Bodily Injury Claim을 오픈해야 한다.
단, 부부인 경우에는 No-fault claim만 가능하기 때문에 주의해야 한다.
따라서 사고가 나면, 대중교통이더라도 반드시 운전자 보험 정보와 운전면허증, 차량 정보를 확보해야 한다.
그리고 No-Fault, Bodily Injury claim을 오픈하고 치료를 받으면 된다.

뉴욕에서 가장 흔한 한도는 25k/50k 이다. 이것의 의미는 사람당 25k($25,000), 사건당 50k($50,000)까지 보상을 해준다는 의미이다. 따라서 이 경우 두 사람까지 사고를 당했을때 받을 수 있는 최고 보상금액은 25k가 된다.
그러나 한 사고에 세사람이 다친경우 최대 사건당 50k 이기 때문에 한 사람이 받을 수 있는 최고 보상은 3/50k 이 된다.
따라서 상대방의 보험에 클레임을 오픈한 후 반드시 BI limit을 확인하는 것이 좋다.

따라서, 만약 변호사에게 의뢰한다면 최소한 2-3 년은 치료를 받으면서 기다린다고 생각해야 제대로 보상을 받을 수 있다.
뉴욕 주 법에 따르면 3년안에 합의를 하지 않으면 법원에 소를 제기하도록 되어 있다.
따라서 3년안에 합의를 할 것인지 소송으로 갈 것인지를 결정해야 한다.
이러한 기본 지식을 알고 있으면 교통사고가 났을때 크게 당황하거나 답답해 하지 않을수 있을 것이다.
