최근 맨하탄 지하철에서는 사건 사고가 많이 일어나고 있다.
코로나 이후 더 많아진 것도 사실이지만, 그 전부터 지하철 사고는 지속적으로 있어왔다.
한국의 지하철도 사고가 많은 것도 사실이지만, 한국과 달리 미국은 지하철 출입에 의외로(?) 자유롭다.
당연히 요금을 내야 하지만, 많은 홈리스나 정신이상자 같은 사람들이 돈을 내지 않고 뛰어 넘거나, 비상문을 열고 지하철에 들어온다.
경찰도 있고, MTA 직원도 있지만..모두 지켜볼 뿐 그 자리에서 잡거나 처벌하지 않는다.
그 이유는 아직 잘 모르겠다. 좀 더 미국에 살아보면 알수 있을까?
여름엔 시원하고 겨울엔 따뜻해서, 홈리스들에겐 더없이 편안한 숙소를 제공하는 지하철..
더구나 맨하탄의 지하철이 잠들지 않는 24시간 운행한다는 점이 그들에게 정말 숙소를 제공하고 있는 점이 아닐수 없다.
Recently, many incidents have occurred in the Manhattan subway.

It is true that Korean subways also have many accidents, but unlike Korea, the United States is surprisingly (?) free to enter and exit the subway.
Of course, you have to pay, but many homeless or insane people jump over or open the emergency door and enter the subway without paying.
There are police and MTA staff, but they all watch but do not catch or punish them on the spot.
I still don't know why. Would you know if you live in the US?
Cool in the summer and warm in the winter, the subway provides the most comfortable accommodation for the homeless.
Moreover, the fact that Manhattan's subway runs 24 hours a day that never sleeps is what really provides them with accommodation.
최근 지하철에서 Self-defense 논란이 된 사건이 두 건 있었다.
한 건은 지하철에서 난동을 부리던 홈리스를 전직 군인 출신인 사람이 제압했으나 일명 "Choke hold"(목조르기? 해드락?)로 홈리스가 사망한 사건이고 다른 한 건은 20대 청년이 지하철에서 사람들을 괴롭히던 홈리스를 칼로 찔러 살해한 사건이다.
두 사람 모두 체포 되었으나 한 건은 아직 판결이 나지 않았고 한 건은 무죄로 풀려났다.
여기에 한 몫을 한 것은 목격자, CCTV 분석 등이었다.
많은 목격자들이 그들을 위해 증언하고 그들이 찍은 비디오를 제출했으며 funding 도 했으니 말이다.
Recently, there were two cases of self-defense controversy in the subway.
In one case, a former soldier subdued a homeless person who was rioting on the subway, but the homeless died as a result of a so-called "Chokehold". It is an incident in which a homeless person who was harassing a person was stabbed and killed with a knife.
Both were arrested, but one was still pending and the other was acquitted and released.
Witnesses and CCTV analysis contributed to this.
Many eyewitnesses testified for them, submitted their videos, and funded them.
미국에서는 이러한 정당방위 -한국에서는 정당방위라고 부르는 이것을 'self - defense'라고 부른다.
그리고 성문법 체계로 정형화되어 유도리가 부족한 한국의 법과는 달리 미국은 판례법주의, 따라서 모든 사건은 case by case 이다.
만약 이러한 사건이 한국에서 일어났다면 어땠을까?
아마 두 건 모두 살인죄로 기소되었을 것이다.
하지만 미국에서는 self - defense를 좀 더 폭넓게 인정하는 듯 보인다.
그만큼 개인의 생명, 재산을 존중하고 서로에게 있어서도 그만큼 존중하는 사회를 만들려고 하는 노력의 하나로 보인다.
이후 지하철에 더 많은 경찰이 배치되고 단속되고 있지만, 이러한 판결은 '착한사마리안 법'이 점점 사라지는 시대에 오히려 좋은 효과를 누릴수 있다고 본다.
남들을 무차별적으로 공격하는 사람들, 나를 공격하는 사람을 나 스스로 지켜도 된다는 것을 보여준 선례가 아닌가 싶다.

Probably both were charged with murder.
However, in the US, self-defense seems to be recognized more broadly.
It seems to be part of an effort to create a society that respects individual life and property and respects each other as well.
Since then, more police have been deployed and cracked down on the subway, but I think this ruling can have a rather good effect in an era where the 'Good Samaritan Law' is gradually disappearing.
I think it is a precedent that showed that I can protect myself from those who indiscriminately attack others and those who attack me.
한국에서는 정당방위를 인정하지 않는 사례가 인정한 사례보다도 많다.
그 누구든 모두의 생명은 소중하지만, 그 누구도 나를 대신해서 지켜줄 수 없다면, 나 스스로 지킬 수 있도록 조금 더 적극적으로 대처할 수 있도록 독려한다면, 상대방 또한 나를 함부로 다루지 않을 것이다.
내가 어느 사람을 괴롭혔을때 그 사람도 그것을 방어하기 위해 적극적으로 대처할 것이라는 인식이 널리 퍼지면,
그 누구든, 상대방을 함부로 대할 수 있을까?
생명을 빼앗는 일은 있어서는 안되는 일이지만, 그 누구도 남을 괴롭힐 권리도 없다.
지하철이 좀 더 안전하고 편안한 교통수단으로 지속되길 바란다.
In Korea, there are more cases that do not recognize self-defense than cases that do.
Everyone's life is precious, but if no one can protect it for me, if I encourage them to take more active measures so that I can protect it myself, the other person will not treat me carelessly.
