H1B 동행없이 H4 Stamp 받기 - H4 stamping without accompanying H1B

오늘은 미국의 대표적인 취업비자인 H1B, 그리고 동반자 비자 H4에 대해 이야기 하고자 한다.

H1B는 미국에서 외국인들이 일할 수 있는 대표적인 비이민비자 이다.

하지만 H1B는 dual intent, 즉 이민을 할 수 있는 의도를 받아주는 비자이기 때문에

이 비자를 가지고 있는 동안 어떠한 경로를 통해 영주권 신청을 하는 것은 가능하다. 

 

Today, I would like to talk about H1B, the representative work visa in the United States, and H4, a companion visa.
H1B is a representative non-immigrant visa that allows foreigners to work in the United States.
However, H1B is a visa that accepts dual intent, that is, the intention to immigrate.
It is possible to apply for permanent residency through any route while holding this visa.

 

대부분 미국에 유학 온 학생들이 학교 졸업 후 OPT 1년,

그리고 H1B를 해주는 회사를 찾아 스폰서쉽을 받게 되면 H1B를 apply 할수 있다.

물론 이 절차는 앞서 포스팅한 바 있다.

H1B와 H4를 만약 자국에서 신청하여 스탬프를 받아서 미국으로 온다면 아무런 문제가 없다.

하지만 많은 유학생들이 미국에 있는 동안,

학교 졸업 후 이 절차를 이어서 진행하다 보니 미국 밖을 나가고 싶으면 문제가 생긴다.

There is no problem if you apply for H1B and H4 in your home country, get a stamp, and come to the United States.
However, while many international students are in the United States,
If you continue this process after graduating from school, problems arise if you want to go outside the United States.

 

미국 밖 다른 곳을 가기 위해서는 여권에 H1B 또는 H4 실물비자와 이 비자를 통해 미국에 입국한 스탬핑이 필요하다.

이 이후에는 비자 유효기간 동안 자유롭게 미국 밖을 오갈 수 있다.

나도 시도해보진 않았지만 캐나다와 멕시코는 스탬핑 없이 육로를 통해 갈 경우 일정의 fee를 내고 임시 스탬핑을 받을 수 있다고 한다.

H1B도 같지만, H4만 한국에서 스탬핑을 받을 경우 준비해야 할 것과 타임라인을 공유해 보고자 한다.

가장 먼저 할 일은 내 비자에 맞는 application을 작성하는 일이다.

물론 미국에서 이미 비자 승인을 받았겠지만, 한번 더 application 이 필요하다.

간단히 말하자면, 미국에서 내 Status는 F1 에서 H1B로 바뀌었지만, 내 실물비자는 아직 없는 셈이다.

따라서 실물비자를 위한 application 이라고 생각하면 된다.

위 사이트에서 start an application으로 시작, 그 다음부터는 retrieve an application을 선택하면 되는데

접수번호를 알고 있어야 하기 때문에 일단 시작해서 중단을 할 때는 반드시 수시 저장과 접수번호를 기록해 두어야 한다.  

그리고 당연히 visa를 신청하는 장소는 한국, 서울을 선택해야 한다. - South Korea, Seoul

작성시 가장 궁금했던 것은 I-797 접수번호 였는데,

이것은 무조건 기본 신청자, 즉 H1B의 접수 번호와 승인번호를 넣어야 한다.

H4를 위한 신청서라도 H1B의 정보를 모두 넣어야 한다.

그리고 또 한가지 헷갈렸던 것은 주소이다.

실제로 지금 미국에 거주하고 있더라도, 

이 신청은 기본적으로 내가 한국에 있기 때문에 신청하는 것을 전제로 하기 때문에 한국 주소를 넣어야 한다.

그리고 미국 거소를 쓰는 란을 따로 있다. 

그리고 최근 5년간의 미국을 오가거나 미국에 체류한 기록, 있다면 모두 기입하는 것이 좋다.

 

What I was most curious about when filling out the application was the I-797 application number.
This must include the application number and approval number of the basic applicant, that is, H1B.
Even if you apply for H4, you must enter all H1B information.
Another confusing thing was the address.
Even if you are currently living in the United States,
This application assumes that you are applying because you are in Korea, so you must enter your Korean address.
And there is a separate section for writing your U.S. address.
It is also a good idea to fill in any records of your travel to or stay in the United States over the past five years.

 

이 모든 신청서 작성이 끝나면 사진을 업로드 해야 한다.

미국 비자 사이즈에 맞는 사진을 업로드 하면  DS-160 작성을 끝이난다.

Complete the DS-160 by uploading a photo that matches the size of your U.S. visa.

 

2. 수수료 지불 및 인터뷰 예약 - Pay fees and schedule interviews

이제 수수료를 지불하면 된다.

일단 저 웹사이트로 들어가서 account를 만들어야 한다.

이때  가장 주의할 점이 있다.

Security 질문이다.

이 문제로 인해 재접속하지 못하는 사람들이 매우 많다.

매우 신중하게 답을 만들고 반드시 기억해두어야 한다.

이것을 잃어버리면 다시는 접속할수 없다.

Account를 만든 후 로그인, 그리고 DS-160 접수번호를 기입하고 수수료를 지불하면 된다.

반드시 한화로 입금해야 하기 때문에 입금은행을 잘 선택해서 해야 한다.

비자별로 수수료는 다르다.

수수료를 납부하면 3시간 안에 사이트에 납부되었다는 표시가 뜬다.

그러면 인터뷰 예약을 할수 있다.

2023년 12월 31일까지는 일부 조건자들에 한해 인터뷰 면제를 해주었다.

이것은 모든 질문에 답하고 나면 마지막 예약확인서에 인터뷰 면제가 되었는지 나오게 된다. 

따라서 그냥 서류만 제출하면 되었다. 

 

Once you pay the fee, a notification that the fee has been paid will appear on the site within 3 hours.
Then you can make an interview reservation.
Until December 31, 2023, interview exemptions were granted only to certain conditions.

After answering all questions, your final reservation confirmation will show whether you have been exempted from the interview.
So, all I had to do was submit the documents.

 

아래는 H4가 H1B동행없이 혼자 비자를 받기 위해 필요한 서류들이다.

 

1. H4를 위한 H1B 제출 서류

만약 비행기가 급박하다면 사정을 좀 설명하는 메모를 넣는 것도 나쁘지 않다.

나도 역시 일주일 밖에 있지 않아서 메모를 남겼더니 좀 더 빨리 진행이 되었다.

If the flight is urgent, it's not a bad idea to include a note explaining the circumstances.
Since I was only there for a week, I left a note and it went a little faster.

 

다음은 H4 인터뷰 면제를 받고 서류를 드랍하고 다시 비자를 받은 타임라인이다.

12.22 - 일양로지스 서류 드랍

12.23-25 - 휴일

12.26 - 접수 그리고 당일 저녁 approved

12.27 - issued

정말 다행히도 빠른 프로세스로 받을 수 있었다.

이번 바이든의 새 발표에 의하면

3년후 연장시에는 미국에서 스탬프를 받을수 있도록 해준다고 하니 다행한 일이 아닐 수 없다. 

하지만 여전히 최초 스탬프는 자국에서 받아야 한다.
