H1B 비자(H1B - visa)

오늘은 H1B visa에 대해 이야기 해 보고자 한다.

학교를 졸업하고 학생 신분이 끝난 후, 취업을 꿈꾼다면, 어떤 비자가 있어야 할까? 

취업을 하기 위해서는 취업에 맞는 비자가 필요하다.

영주권을 기반으로 한 이민 비자들도 있지만, 많은 사람들이 알고 있는 비자가 H1B이다.

H1B visa는 nonimmigration 비자로 분류는 되지만, 이민과 비이민 모두를 포용하는 비자이다.

따라서 이 비자 상태에서는 이민을 신청해도 이상하게 여기지 않는다는 의미이다.

하지만 취업하고자 하는 회사에서 스폰서를 해주어야만 한다.

이전에는 회사에서 고용주가 고용인을 위해 스폰서를 하겠다고 하면, application을 작성해서 file을 하고, 

이들 중에서 최종 lottery가 되는 방식이었다.

하지만, 이제는 3월에 lottery를 먼저 등록하고, lottery에 뽑히게 되면, 그제서야 고용주가 고용인을 위해 file을 하고 최종 결과를 다시 기다려야 한다.

이전에는 한 번만 기다리면 되었지만, 이제는 두 번을 기다려야 하는 셈이다.

일단 lottery에 되어야 하고, file 후 최종적으로 deny가 나지 않도록 해야 하는 것이다.

H1B에서 중요한 점은 자신의 전공 분야와 맞는 직업 군, 그리고 Salary, Position 이다.

자신의 학위에 맞는 직업, 그리고 거기에 맞는 salary, 그리고 position이어야 한다는 것이다.

또한, 모든 fee는 고용주가 지급하게 되어 있다.

하지만, 많은 고용주가 fee에 대한 부담 등으로 스폰서를 꺼려한다.

또한 application을 file 하기 위해서는 회사 인원수, 회사 규모, 설립시기와 운영방식, 그리고 tax넘버, 회사 수입 등 모든 회사 정보를 밝혀야 한다.

이러다 보니, 많은 고용주들이 이러한 부담을 안고 굳이 외국인 직원을 채용하려고 하지 않는다.

그래서 학생비자 후 H1B를 얻어 취업을 하기란 매우 힘든것이 현실이다.

H1B lottery만큼이나 스폰서를 해주는 회사를 구하기가 힘들다는 것..

H1B는 영주권을 보장하는 비자가 아니다.

3년이 유효기간이고 고용주가 연장을 원하면 3년 더 연장할 수 있다.

가장 좋은 것은 이 기간 동안 영주권을 받는 것이다.

영주권은 다음 포스팅에 자세히 언급하겠지만, 이 역시 쉬운 일은 아니다.

그리고 H1B 기간동안 laid off가 된다면, 60일의 기간이 주어지고 그 사이에 다른 스폰서를 구하지 못하면 미국을 떠나야 한다.

물론, 또 다른 비자로 변경을 시도할 수 있겠지만, 그역시 쉽지는 않다.

H1B를 한번 받으면 다른 곳에서도 또 받을 수 있다. 

그리고 한 회사에서 다른 회사로 옮기는 것도 가능하다. 

하지만 이 또한 승인은 기다려야 한다.

 

H1B is not a visa that guarantees permanent residency.
It is valid for 3 years and can be extended for another 3 years if the employer wishes to extend it.
The best thing is to get a permanent residence permit during this period.
The permanent residency will be discussed in detail in the next post, but this is also not an easy task.
And if you are laid off during the H1B period, you will be given a period of 60 days, and if you cannot find another sponsor during that time, you must leave the US.
Of course, you can try changing to another visa, but that's not easy either.
Once you get your H1B, you can get it again.
And it is possible to move from one company to another.
However, this will also have to wait for approval.

 

미국에서 살아가기 위해 영주권이 필요하지만, 그길은 결코 쉽지 않다.

하지만, 또 불가능한 일은 아니다.

흔히들, 버터야 한다고 말하는 이유가 그것이다.

이를 포기하고 미국을 떠나면, 그 기회는 다시 원점으로 돌아간다.

만약 미국에서 영주권, 시민권을 받고 싶다면, 포기하지 말고 버티자.

그리고 생각보다는 많은, 다양한 방법이 있다는 것도 명심하자.
